CASL sends a strong message about consent and compliance when sending emails. It takes aim at unsolicited e-mail marketing messages, a long time inbox nuisance by invoking fines of up to 1 million CAD for individuals, and up to 10 million CAD for corporations — for each violation. But the new legislation goes beyond spam, hacking and fraud. Along with traditional spam, it prohibits sales-geared “Commercial Electronic Messages” (CEMs) sent without the recipient’s consent. CEMs can include promotional emails, instant or text messages, and even direct exchanges on social media platforms like LinkedIn.
